TERMS AND CONDITIONS OF ENROLMENT

Performers of Wivenhoe (POW) - Parent/Guardian Agreement

By enrolling your Young Performer at Performers of Wivenhoe (POW), you agree to these terms and conditions ("Terms & Conditions") and acknowledge your acceptance of them as a binding agreement between you and Performers of Wivenhoe (POW) ("Agreement").

This Agreement is made between the parent/guardian ("Parent/Guardian", "you", or "your") of each enrolled Young Performer and Performers of Wivenhoe (POW) ("POW", "we", "our", or "us"). It remains valid for the duration of the Young Performer's enrolment in any POW activity and until written notice is provided in accordance with these Terms & Conditions.

1. INTRODUCTION

1.1 These Terms & Conditions apply to all activities offered by POW, including but not limited to classes, courses, holiday workshops, and any additional services or products ("POW Activities").

​

1.2 To enrol a Young Performer in a POW Activity, Parents/Guardians must agree to these Terms & Conditions by signing and returning the POW Parent Agreement. POW reserves the right to update these Terms & Conditions periodically.

​

1.3 Existing Parents/Guardians will be notified of any changes to these Terms & Conditions. Unless you contact us within fourteen (14) calendar days of receiving the updated Terms & Conditions, your continued enrolment of a Young Performer in POW Activities will be deemed as acceptance of the revised terms.

1.4 Any amendments to these Terms & Conditions require the written consent of Performers of Wivenhoe (POW).

​

1.5 A "Course" refers to a series of weekly classes in acting, movement and song, delivered during the academic term (including online sessions). The duration and schedule of each Course will be specified at the time of booking.

​

1.6 A "Holiday Workshop" refers to workshops (including online activities) run by POW during school holidays.

​

1.7 "Term" refers to one academic term during which Courses are delivered.

​

1.8 "Term Dates" refer to the specific dates for each Term.

​

1.9 "Online Activity" refers to live-streamed lessons or workshops delivered via digital platforms.

​

2. ENROLMENT

2.1 To enrol a new Young Performer in a POW Activity, Parents/Guardians must agree to these Terms & Conditions and return the signed POW Parent Agreement.

​

2.2 Places are allocated on a first-come, first-served basis. Applications must be accompanied by the required payment.

​

2.3 Fees are payable in advance. An invoice will be issued at the start of each billing period. Repeated non-payment may result in the Young Performer losing their place at POW.

​

2.4 For Holiday Workshops, full payment must be made before the start of the activity.

​

2.5 If POW is unable to accept a Young Performer due to capacity limitations, the Young Performer may be placed on a reserve list at the Parent's/Guardian's discretion.

​

2.6 Parents/Guardians have a fourteen (14) calendar day cancellation period ("Cancellation Period") from the date of the first payment to cancel the Young Performer's place.

 

3. PAYMENTS

3.1 All payments must be made by bank transfer to the account specified by POW.

​

3.2 For Holiday Workshops, full fees are paid in advance as outlined in clause 2.4.

​

4. COURSES

4.1 Term Dates for the following Term will be communicated to Parents/Guardians in writing at the end of the current Term.

​

4.2 If a Course session falls on a bank holiday, a replacement class will be scheduled.

​

4.3 POW will contact Parents/Guardians mid-term to confirm intentions for the following Term. Continued enrolment requires confirmation by the stated deadline.

​

5. TASTER SESSIONS

5.1 New Young Performers may attend one complimentary Taster Session before enrolling.

​

5.2 Following the Taster Session, POW will contact Parents/Guardians to discuss permanent enrolment.

​

6. HOLIDAY WORKSHOPS

6.1 Parents/Guardians of enrolled Young Performers will not receive priority booking for Holiday Workshops.

​

6.2 Dates and times for Holiday Workshops will be published on the POW website and communicated via email.

​

6.3 Cancellations made within five (5) calendar days of the workshop start date will result in forfeiture of full fees.

​

7. USE OF PERSONAL INFORMATION

7.1 Personal data will be processed in accordance with POW's Privacy Policy.

​

7.2 All intellectual property created during POW Activities remains the property of Performers of Wivenhoe (POW).

​

7.3 Recorded content may be used in accordance with POW's Social Media Policy.

​

8. HEALTH AND SAFETY

8.1 Young Performers participate at their own risk. Parents/Guardians must disclose any medical conditions or injuries on the enrolment form and notify POW of any changes in writing.

​

8.2 In case of emergency, Parents/Guardians will be contacted using the details provided. POW reserves the right to seek emergency medical treatment if necessary, with any associated costs being the responsibility of the Parent/Guardian.

​

8.3 Young Performers must wear appropriate clothing and footwear for all activities.

​

9. FORCE MAJEURE

9.1 In the event of unforeseen circumstances including but not limited to pandemics, extreme weather, or other force majeure events necessitating cancellation of sessions, POW will endeavour to:

​

Reschedule affected sessions where possible; or
Provide account credit for future sessions.

​

9.2 Cash refunds will not typically be offered in such circumstances, though exceptions may be considered on a case-by-case basis.

​

10. PERSONAL PROPERTY

10.1 Young Performers are responsible for their own belongings. POW accepts no liability for lost or damaged items.

​

11. GENERAL

11.1 POW reserves the right to refuse entry to any Young Performer whose behaviour is deemed unacceptable.

​

11.2 Timetables, staff and programme delivery methods may be subject to change due to unforeseen circumstances.

​

11.3 These Terms & Conditions, along with any invoice or acceptance letter, constitute the entire agreement between the parties.

​

11.4 This Agreement shall be governed by and construed in accordance with English law.
